ONLINE STORE. By agreeing to these Terms of Use, Certain products may be available exclusively online through the website. All products  are sold “As Is” and may have limited quantities and are subject to return or exchange only according to our Return Policy. We reserve the right to limit the quantities of any products or services that we offer.

CREDIT CARD INFORMATION FOR PURCHASES. I authorize Alvin and Friends to charge  the credit card I provided. I represent that I have read and agree to the full Terms of Use governing all transactions, and I understand that I am liable for payment of all product shipped to me.

SHIPPING. All orders are processed within 2-3 business days. Orders are not shipped or delivered on weekends or holidays. If we are experiencing a high volume of orders, shipments may be delayed by a few days. Please allow additional days in transit for delivery. If there will be a significant delay in shipment of your order, we will contact you via email. You will receive a Shipment Confirmation email once your order has shipped containing your tracking number(s). The tracking number will be active within 24 hours. Windy Ridge is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim. We currently do not ship outside the U.S. Windy Ridge ships to addresses within the U.S., U.S. Territories, and APO/FPO/DPO addresses.

DELIVERY. Please allow 2 business days for orders to be processed. Windy Ridge makes every effort to ship orders promptly, but we do not guarantee when your order will ship. Windy Ridge ships packages via USPS with two options for our customers: first class mailing and priority mailing. Windy Ridge is not responsible for any order that is stolen from the customers’ address, lost in transit, not delivered, or seized.

LIABILITY AND INDEMNITY. By purchasing any product on this website you agree to indemnify, defend and hold Alvin and Friends and its agents, managers, officers, directors and employees harmless from and against any and all liabilities, losses, damages, and expenses, including reasonable attorneys’ fees (collectively, “Claims”) arising from any acts or omissions you commit, including but not limited to, violation of any applicable law, regulation, or order.

DISCLAIMER. None of the products listed on this website have been approved by the FDA and are not intended to diagnose, treat, or cure any disease or ailment. By making a purchase from our company, you are agreeing to the following statement:

IN THE EVENT OF ANY PROBLEM WITH THE PRODUCTS YOU HAVE PURCHASED ON OR THROUGH THIS WEB SITE, YOU AGREE THAT YOUR SOLE REMEDY, IF ANY, IS TO SEEK A RETURN AND REFUND FOR SUCH PRODUCT OR SERVICES IN ACCORDANCE WITH THE RETURNS AND REFUNDS POLICIES POSTED ON OUR SITE.

 SEVERABILITY.  ARBITRATION. If at any time any dispute, difference, or disagreement shall arise upon or in respect of these Terms of Use, and the meaning and construction hereof, every such dispute, difference, and disagreement shall be referred to a single arbiter agreed upon by the parties, or if no single arbiter can be agreed upon, an arbiter or arbiters shall be selected in accordance with the rules of the American Arbitration Association and such dispute, difference, or disagreement shall be settled by arbitration in accordance with the then prevailing commercial rules of the American Arbitration Association, and judgment upon the award rendered by the arbiter may be entered in any court having jurisdiction thereof. Any Arbitration shall occur in the State of Oregon. The Federal Arbitration Act governs the interpretation and enforcement of this provision.

 LAW. This Agreement shall be governed in all respects by and construed under the laws of the State of Oregon as such laws are applied to agreements between Oregon residents entered into and to be performed entirely within Oregon. Any action not subject to mandatory arbitration shall be instituted concerning the enforcement or interpretation of the Terms of Use in the Oregon courts and you agree to submit to the jurisdiction of the courts.  

ATTORNEY FEES. In the event an arbitration, suit or action is brought by any party under this Agreement to enforce any of its terms, or in any appeal therefrom, it is agreed that the prevailing party shall be entitled to reasonable attorney’s fees to be fixed by the arbitrator, trial court, and/or appellate court.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Use by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Services following the posting of any changes to these Terms of Use constitutes acceptance of those changes.

• TAXES. Windy Ridge shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the state of Oregon. For orders shipped to other states or countries, you are solely responsible for all sales taxes, customs, duties, or other taxes.
